AN ORDINANCE TO PROVIDE A REBATE FOR SEWER UTILITY FEES TO
CLARK SENIOR CITIZENS ELIGIBLE FOR THE STATE OF NEW JERSEY
PROPERTY TAX REIMBURSEMENT PROGRAM
WHEREAS the State of New Jersey has adopted legislation
which exempts Senior Citizens who are eligible for the
State's Property Tax Reimbursement Program from the
payment of taxes in addition to other legislation which
also provided tax relief to Senior Citizens; and
WHEREAS the Governing Body of the Township of Clark in
furtherance of the policy established by the State of New
Jersey of providing tax relief to its' Senior Citizens is
desirous of affording Clark Senior Citizens with similar
benefits; and
WHEREAS the Governing Body of the Township of Clark has
recently created a sewer utility, the purpose of which is
to provide for the payment of sewer fees based on usage in
order to generate revenues to pay for the treatment,
operation, and maintenance of the sewer system utilized by
the Township of Clark; and
WHEREAS the removal of said costs from the property tax
would adversely affect the Senior Citizens in the Township
who are eligible for the State of New Jersey Property Tax
Reimbursement (PTR) Program.
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1. Senior Citizens Defined. For the purpose of
this Ordinance, a Senior Citizen means a person owning
real estate and legally domiciled with the Township of
Clark who has completed all the eligibility requirements
for participation in the State of New Jersey's Property
Tax Reimbursement Program.
SECTION 2. Rebate. All qualified Senior Citizens who are
owners of real estate within the Township of Clark shall
upon submission of proof of eligibility for the New Jersey
Property Tax Reimbursement Program receive a refund equal
to the minimum fee required to be paid to the Clark
Township Sewer Utility for service. It is further provided
that no refund will be made without the formal filing of
PTR eligibility with the Township Sewer Utility.
SECTION 3. Inconsistent Ordinance. Any ordinances
inconsistent with the foregoing are hereby repealed to the
extent of such inconsistency.
SECTION 4. Effective Date. This Ordinance shall take
effect upon adoption and upon publication according to
law.

AN ORDINANCE TO ESTABLISH AND COLLECT USER FEES FOR THE
COLLECTION AND TREATMENT OF WASTEWATER
WHEREAS the Township of Clark has established the Clark
Township Sanitary Sewer Utility to operate and maintain
the Municipal sanitary sewer system; and
WHEREAS the Clark Township Municipal Sewer Utility will
incur various expenses to perform its purpose.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Council of
the Township of Clark as follows:
1. The purpose of this ordinance is to impose an annual
"user fee" as hereinafter defined on all domestic,
commercial, industrial, institutional and government users
of the Sanitary Sewer Utility of the Township of Clark.
2. User fee is defined as a fee levied upon all users of
the Sanitary Sewer Utility for the annual cost of
operation and maintenance of the Clark Township Sanitary
Sewer Utility.
3. CLASSES OF USER
The following classes of user are hereby established:
a) Residential Domestic
b) Commercial Domestic
c) Governmental
d) Not-for-Profit
e) Industrial (Non-SIU)
f) Significant Industrial Use (SIU)
4. DEFINITIONS
a) Residential Domestic - any user where sole use of
property is as a residential dwelling unit
b) Commercial Domestic - any user not classified elsewhere
herein
c) Governmental - any user operating as an extension of
the Federal, State, County, or Municipal Government
d) Not-for-Profit - users designated as 501c (6) or 501c
(3) under the IRS tax code
e) Industrial Users - users located within an industrial
zone of the Township of Clark that generates wastewater
other than domestic waste as a result of their operation
such as process water, cooling water, washdown etc. Such
users will not generate sufficient quantities of
wastewater to be classified as Significant Industrial
Users by the New Jersey Department of Environmental
Protection and/or the Rahway Valley Sewerage Authority.
f) Significant Industrial Users - Industrial Users
generating sufficient wastewater quantities to meet
definitions established by the New Jersey Department of
Environmental Protection and/or the Rahway Valley Sewerage
Authority and shall meet all Township, RVSA and NJDEP
monitoring and reporting requirements.
5. USER FEES
User fees are established as follows:
a) RESIDENTIAL

f) SIGNIFICANT INDUSTRIAL USERS
Billing will be based on fees charged by the Rahway Valley
Sewerage Authority based on flow, BOD, and TSS. The Clark
Township Sanitary Sewer Utility will assess a ten (10)
percent administrative charge on such charges.
6. CALCULATION OF USAGE
The Clark Township Sanitary Sewer Utility will assess user
fees based on October thru March water usage as reported
by the appropriate water purveyor. Said amounts will be
multiplied by two (2) to achieve an annualized flow
estimate.
7. BILLING OF USER FEES
User fees will be billed for the year 2006 with payment in
full due on or before July 15. Thereafter, charges will be
billed annually with payments due on or before March 15
and September 15.
8. LATE PAYMENTS
Users will be subject to the payment of interest and
penalties for payments received after the due date. Users
will be assessed penalties in the manner established by
the Township for payment on late property tax payments.
9. APPEALS
Users who believe that either flow or classification has
been improperly calculated shall submit written
documentation to the Utility Engineer requesting to effect
an appeal to the Governing Body.
10. All ordinances or parts of ordinances or resolutions
that are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
11. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed
severable and shall remain in full force and effect.
12. This Ordinance shall take effect after publication and
passage according to law.

Leaky Faucet 2000 Gallons per year $10.

By installing more efficient fixtures and checking
regularly for leaks, the typical homeowner can reduce his
water bill by 35 percent.
Eliminate leaks. Check inside and outdoor faucets.
Install faucet aerators/water-save showerhead (50 percent
savings)
Install water-save toilet (50 percent savings)
Front load washer (15 gallons per load)
Run washer/dishwasher only when full (1000 gallons per
month)
Turn off water while brushing teeth (100-200 Gallons per
week)
Turn off water while shampooing/conditioning (50 gallons
per week)
Turn off water while shaving (100 gallons per week)
How do I check for leaks??
Turn off all faucets. Read the water meter when not using
shower, washer/dishwasher etc. . Wait 15-30 minutes and
read the meter again. If the meter reading is different,
there is a leak somewhere. Contact a plumber if you can
not address the leaks yourself.
How can you check if the toilet is leaking?
Add food coloring to the tank. If it shows up in the bowl
without flushing, there is a leak.
